Lindsay Lohan is suing Etrade for using her first name in a Super Bowl ad. Lohan filed a $100 million lawsuit against E*TRADE after they ran a baby milkaholic commercial last month during the Super Bowl, which her lawyer says violates Lohan’s rights by using her "name and characterization."

Lohan’s lawyer, Stephanie Ovadia, said although the ad doesn’t use the name Lohan, Lindsay is a house hold name:

"Do you know the name Oprah? Do you know the name Madonna? Same thing."

Really? Does Lindsay only bill herself as Lindsay? No. Lindsay always uses her last name as well. Besides, this is a humorous commercial, and as long as the ad is poking fun at someone, or something, they are within their legal right. Ever heard of Saturday Night Live? SNL doesn’t need to pay anyone to make fun of them. Lindsay wants free money, but I’m hoping she just ends up with more legal bills.

I found 3 trademarks for the name Lindsay filed by 3 different companies, and none filed by Lindsay Lohan. The only trademark filed by Lindsay Lohan is for her full name "Lindsay Lohan." Without the last name Lohan doesn’t appear to have a case.

Here’s something for Lohan to think about. Is it really so bad to be called a MILK-aholic, if they were talking about you? I would think milk addiction is better than alcohol addiction. Even if the ad was talking about Lohan, they could have used her first and last name, and still have been within the confines of the law.

I think this is another situation where Lindsay Lohan is chasing her tail again.
